These terms are the contract between you and me when you use Súbelo. By creating an account you accept them. They are written so that they are understood; If something is not clear to you, write to me at hola@subelo.app before registering.
Who provides the service

What is Súbelo
Súbelo publishes the same vertical video on the social networks that you connect (Instagram, TikTok, YouTube and LinkedIn, today), with the description adapted to each one.
Súbelo is not affiliated with, sponsored or endorsed by Meta, TikTok, Google or LinkedIn. It is limited to using the public APIs that these companies offer to developers.
Who can use it
You must be over 18 years of age and only connect accounts that you are the owner of or that you have express authorization to publish on. If you manage a client's accounts, you are the one responsible for having that permission.
You are responsible for the security of your account. Notify me as soon as you suspect that someone has entered without your permission.
Plans and payments
The plans and their prices are published on the website. All prices are shown with applicable VAT included depending on your country.
Free trial with automatic renewal. On your first subscription you can activate 7 days free by entering a card in Stripe. The trial starts when you confirm your subscription. Upon completion, the plan fee indicated on the payment screen is automatically charged: Creator, €38.70 every three months (equivalent to €12.90/month, one account per network); Solo, €19/month; Pro, €39/month; or Agency, €59/month. It is renewed with the frequency of the chosen plan until you cancel. Before confirming you will see the date of the first payment and you will expressly accept the renewal. Cancel from My Account before the trial ends to avoid the first charge. You can also subscribe without a trial and pay from the first day. Previous trials offered without a card retain their conditions and do not automatically become paid.
Renewal. Creator is charged for complete quarters: €38.70 every three months. The Solo, Pro and Agency plans are renewed every month. You can cancel the renewal at any time; Access lasts until the end of the paid period. Existing subscriptions maintain their price and frequency, unless the plan changes confirmed by the owner.
Cancellation. You can cancel whenever you want from your panel, in two clicks and without calling anyone. By canceling you maintain the service until the end of the period you have already paid for. There is no refund of the unconsumed part of the current period, except in the cases of the following section.
Failed payments. If a payment fails, I will retry it for a few days and notify you by email. If not resolved, the subscription is suspended.
Price changes. If I raise the price, I will let you know 30 days in advance and you can cancel before it is applied. It is never applied to a period already paid.
Right of withdrawal
If you contract as a consumer, the law gives you 14 calendar days to withdraw without giving explanations. Now, when contracting I ask you to expressly confirm that you want the service to start immediately, and the law itself establishes that in that case you lose the right of withdrawal once the service has been completely provided. In practice, and because it seems fair to me, I apply this: if in the first 14 days you have not published a single video with Súbelo, I will refund the full amount if you ask me.

What you can publish and what you cannot
You are solely responsible for the videos, texts and hashtags you upload, and for having the rights to them, including the music.
You may not use Súbelo to post illegal, copyright-infringing, hateful, violent, sexual content involving minors, misleading, or fraudulent content, nor to automate spam or simulate activity from accounts you do not control.
Additionally, everything you post through Súbelo must comply with the community guidelines and terms of Instagram, TikTok, YouTube, and LinkedIn. Súbelo does not exempt you from anything against them.
If I detect usage that violates this, I may suspend the account without refund.
Who owns your videos?
Yours. Súbelo does not acquire any rights over your content.
You grant me only the strictly necessary and time-limited license to host and transmit your videos to the platforms you choose and show you their preview. That license expires when the file is deleted: once you finish sending it, it is kept for 48 hours and is deleted in the next automatic cleanup, which runs every hour, or sooner if you delete it. Files with pending posts are retained for completion.
I do not use your content to promote Súbelo unless you give me written permission for a specific case.
Limits that do not depend on me
Súbelo depends on the Meta, TikTok, Google and LinkedIn APIs. That means that:
Each platform imposes its own limits on daily posts, duration, format and size, and may change them without notifying me.
A platform may reject a video, remove it, or suspend your account based on its own rules. This is beyond my control and does not generate the right to a refund.
If a platform cuts access to its API, withdraws a permission or changes its conditions so that Súbelo can no longer publish there, I will inform you as soon as possible. If that leaves the service substantially unusable for what you contracted, I will refund the proportional part not consumed.
Some integrations may still be in the platform's approval process. While a network is not fully enabled, its posts may remain private or limited to test accounts. At all times you will see within the application itself which networks are available and in what mode.
Availability
I use reasonable means to ensure that this always works, but I do not promise you uninterrupted or error-free service. There will be maintenance, and sometimes there will be breakdowns.
What I do commit to doing: automatically retry posts that fail for technical reasons, and notify you when something has not worked.
Responsibility
I am liable for any damages caused to you by breaching these terms, up to the limit of the amount you have paid me in the previous 12 months.
I am not responsible for lost profits, loss of followers, reach or commercial opportunities, or for the decisions that platforms make about your accounts or your videos.
None of this limits the liability that the law does not allow to limit, nor your rights as a consumer.
Suspension and closure
You can close your account whenever you want from Settings. Doing so deletes your videos and network credentials, as explained in the privacy policy.
I may suspend or close your account if you breach these terms, if you use the service in a way that puts Súbelo's access to the platforms' APIs at risk, or if you stop paying. Except in serious cases, I will notify you beforehand and give you time to correct it.
Changes to these terms
If I modify them, I will notify you by email 15 days in advance. If you do not agree, you can cancel free of charge before they come into effect.
Applicable law and claims
Spanish law applies.
If you are a consumer, you can complain before the courts of your domicile and go to the European online dispute resolution platform. If you contract as a company or professional, the parties submit to the courts of Murcia.
